Terms of Use

ACCEPTANCE OF TERMS

These Terms of Use ("Terms") govern your access to and use of the Vincerò Auctioneers website, mobile application, and associated online and offline auction services (collectively, the "Platform").

 

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Platform.

DEFINITIONS

  • "Company" refers to Vincerò Auctioneers (Pty) Ltd.

  • "User" means any individual or entity accessing or using the Platform.

  • "Auction" includes both online and offline auction events facilitated by the Company.

 

USER ACCOUNT AND REGISTRATION

Users must provide accurate, current, and complete information during the registration process.

 

Users are responsible for maintaining the confidentiality of their account credentials and all activities under their account.

 

The Company reserves the right to:

  • Suspend or terminate accounts

  • Refuse registration

  • Require additional verification at any time

 

INFORMATION ACCURACY DISCLAIMER

The Company provides auction listings and item descriptions "as is" and makes no warranties about the accuracy, completeness, or reliability of the information.

 

Users acknowledge that:

  • Item descriptions may contain errors

  • Images may not perfectly represent actual items

  • The Company is not responsible for discrepancies between descriptions and actual items

 

INFORMATION ACCURACY DISCLAIMER

 

The Company provides auction listings and item descriptions "as is" and makes no warranties about the accuracy, completeness, or reliability of the information.

 

Users acknowledge that:

  • Item descriptions may contain errors

TECHNICAL LIMITATIONS AND SERVICE INTERRUPTIONS

The Company does not guarantee:

  • Uninterrupted or error-free service

  • Continuous internet connectivity

  • Immediate processing of bids

 

Users acknowledge potential service interruptions due to:

  • Technical maintenance

  • Internet connectivity issues

  • Server failures

  • Third-party service provider problems

 

The Company is not liable for:

  • Lost or delayed bids

  • Inability to place bids

  • Partial or complete service unavailability

 

BIDDING AND AUCTION PARTICIPATION

Users agree that:

  • Bids are legally binding

  • Automated bidding is subject to pre-set user-defined maximum bid limits

  • The Company reserves the right to cancel or modify auctions

 

Bidding Rules:

  • Users must be 18 years or older

  • Proper identification may be required in accordance with the Financial Intelligence Centre

  • The Company may reject bids at its discretion

  • Every auction has specific Rules of Auction / Rules of Online Auction that bidders must accept before placing bids.

FEES AND FINANCIAL TERMS

​

Users are responsible for:

  • Auction fees

  • Buyer's premiums

  • Applicable taxes

  • Shipping and handling costs

 

Payment terms:

  • Immediate payment upon winning a bid and before transference of ownership

  • Accepted payment methods will be specified for each auction

  • Late payment may result in account suspension

 

INTELLECTUAL PROPERTY

All content on the Platform is protected by copyright and other intellectual property laws.

 

Users may not:

  • Reproduce Platform content without written permission

  • Use Company trademarks without authorization

  • Scrape or extract data from the Platform

 

LIABILITY LIMITATIONS

​

The Company's total liability is limited to:

  • The winning bid value of the specific auction item

  • Direct damages, excluding consequential or indirect damages

  • Maximum limit of fees paid for the specific transaction

 

Users expressly release the Company from liability related to:

  • Item condition

  • Shipping delays

  • Third-party interactions

  • Technical service interruptions

 

INDEMNIFICATION

Users agree to indemnify and hold the Company harmless from:

  • Claims arising from user actions

  • Breach of these Terms

  • Legal costs and expenses

  • Third-party claims related to user activities

 

DATA AND PRIVACY

​

Personal information is handled according to the Company's separate Privacy Policy.

 

Users consent to:

  • Data collection

  • Communication regarding auctions

  • Potential marketing communications

 

MODIFICATIONS TO TERMS

The Company reserves the right to modify these Terms at any time.

 

Continued use of the Platform constitutes acceptance of updated Terms.

 

GOVERNING LAW

​

These Terms are governed by the laws of South Africa.

 

Any disputes will be subject to the jurisdiction of the courts in the Company's primary jurisdiction.

BY REGISTERING AND PARTICIPATING IN ANY AUCTION USING OUR PLATFORM, THE USER EXPLICITLY CONFIRMS THEY HAVE READ, UNDERSTOOD, AND WILL FULLY ABIDE BY THESE TERMS OF USE AND THE COMPANY'S CURRENT RULES OF AUCTION, WHICH ARE INCORPORATED HEREIN BY REFERENCE AND AVAILABLE ON THE PLATFORM.
